legal action. Don't inadvertently set yourself up in a situation that is void
or voidable as to state law, but for which you would need to expend
substantial legal fees to resolve. It's always better to make sure that you
cover these potential problems by having your own legal counsel review an
agreement you make when you are under financial duress.
A word of caution: BE VERY
CAREFUL when you are dealing with people who call themselves real estate
investors, but who do not have successful track records or any professional
affiliations -- you are probably more likely to be taken advantage of
particularly if you do not have legal counsel.
They may also be required to have
a real estate license in Arizona and Florida if they are offering to help you
sell your property or using words to that effect.

Unlicensed real estate activity is a 3rd degree
felony in Florida, effective July 1, 2003. On January 17, 2004 the unlicensed
activity probable cause panel of the Florida Real Estate Commission met and
reviewed 90 cases against unlicensed individuals, resulting in 45
administrative complaints, 15 cease and desist orders, 22 dismissals and 8 nolle prosequi. The State of Florida is serious about compliance.
Florida Statutes, Chapter 475.43, states:
475.43
Presumptions.--In all
criminal cases, contempt cases, and other cases filed pursuant to this
chapter, if a party has sold, leased, or let real estate, the title to which
was not in the party when it was offered for sale, lease, or letting, or such
party has maintained an office bearing signs that real estate is for sale,
lease, or rental thereat, or has advertised real estate for sale, lease, or
rental, generally, or describing property, the title to which was not in such
party at the time, it shall be a presumption that such party was acting or
attempting to act as a real estate broker, and the burden of proof shall be
upon him or her to show that he or she was not acting or attempting to act as
a broker or sales associate. All contracts, options, or other devices not
based upon a substantial consideration, or that are otherwise employed to
permit an unlicensed person to sell, lease, or let real estate, the beneficial
title to which has not, in good faith, passed to such party for a substantial
consideration, are hereby declared void and ineffective in all cases, suits,
or proceedings had or taken under this chapter; however, this section shall
not apply to irrevocable gifts, to unconditional contracts to purchase, or to
options based upon a substantial consideration actually paid and not subject
to any agreements to return or right of return reserved.
Substantial consideration, as stated in Florida law, has been
interpreted by Florida courts to be a minimum of one percent (1%) of the
property's value.
